    I mean, that’s a huge difference, and is usually a major factor in how homicide cases are resolved. There are prolonged discussions about exactly this sort of thing in every city all the time.

    It’s like how there are war crimes that don’t amount to genocide, or thefts of a small enough amount that they don’t rise to the felony level. “Exactly how bad is this bad thing” is a totally legitimate discussion.

      But it’s still a murder with intent and knowing that actions will result in a murder, both are murder. You won’t be seeing prolonged discussions on whether or not it was a murder.

      War crime is war crime, whether it’s gassing in trenches or executing POWs.

      Pedophilia is pedophilia, it can or not involve rape and the severity varies, but it’s still pedophilia and should be judged as such.
